NICA Merchandise - Terms & Conditions of Sale

1. ACCEPTANCE OF TERMS
By placing an order for merchandise ("Goods") from the National Institute of Circus Arts (NICA) ("Seller," "we," "us," or "our"), you agree to be bound by these Terms and Conditions of Sale ("Terms"). Please read these Terms carefully before placing an order. These Terms constitute a legally binding agreement between you and the National Institute of Circus Arts (NICA).
2. ORDERS
2.1. Placing an Order: To place an order, you must be at least 18 years old and capable of entering into a binding contract. By placing an order, you represent that you meet these requirements.
2.2. Order Confirmation: After placing an order, you will receive an email confirming the details of your order.
2.3. Acceptance of Order: We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing, or suspicion of fraudulent activity.
3. PRICING AND PAYMENT
3.1. Pricing: All prices are in Australian Dollars (AUD) and inclusive of Goods and Services Tax (GST), unless otherwise stated. Prices do not include shipping charges.
3.2. Payment: Payment is due at the time of order placement. We accept Credit Card, Debit Card, or Cash.
4. SHIPPING AND DELIVERY
4.1. Shipping Charges: Shipping charges are additional and will be calculated at checkout. The cost depends on the delivery location and the size and weight of the Goods.
4.2. Delivery Times: We aim to dispatch orders within 5 business days after order confirmation. Delivery times may vary based on the shipping method and your location.
4.3. Delays: We are not responsible for delays in delivery caused by factors beyond our control, including but not limited to weather conditions, transportation issues, or customs clearance.
5. RETURNS AND REFUNDS
5.1. Returns: We accept returns within 7 days of receipt of the Goods for products that are faulty or defective. To initiate a return, please contact our administration team. Goods must be returned in their original condition and packaging.
5.2. Refunds: Refunds will be processed within 5-10 business days of receiving the returned Goods. Refunds are only applicable for faulty or defective Goods, and not for change of mind.
Please Note: We do not offer refunds for change of mind or if you simply no longer want the product. Ensure that you carefully consider your purchase before completing your order. If you have any questions about a product, please contact our customer service team for assistance prior to making your purchase.
6. WARRANTIES AND DISCLAIMERS
6.1. Warranty: Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
6.2. Limitation of Liability: To the extent permitted by law, our liability for any claim arising out of the purchase of Goods is limited to the purchase price of the Goods.
7. AMENDMENTS TO TERMS
We reserve the right to amend these Terms at any time. Any changes will be effective immediately upon posting on our website.
8. GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
